By accessing or using CloudA.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

CloudA.ai is an AI-powered platform that generates cloud infrastructure architecture diagrams based on natural language descriptions. The Service includes:

  • AI Studio: AI-powered diagram generation from text prompts
  • Diagrams Editor: Manual code-based diagram creation and editing
  • Templates and example diagrams
  • Export and sharing capabilities

3. User Accounts

Account Registration

You may need to create an account to access certain features. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept all responsibility for activity under your account
  • Notify us immediately of any unauthorized use

Account Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian.

4. AI-Generated Content

Content Generation

Our AI models generate diagrams based on your prompts. You acknowledge that:

  • AI-generated content may contain errors or inaccuracies
  • Generated diagrams are suggestions and should be reviewed before use
  • We do not guarantee the technical accuracy or completeness of generated content
  • You are responsible for verifying and validating all generated diagrams
  • AI outputs are non-deterministic and may vary for similar prompts

Prohibited Prompts

You agree not to use the Service to generate content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights
  • Contains malicious code or security vulnerabilities
  • Is intended to harm, abuse, or harass others
  • Attempts to reverse engineer or manipulate our AI models

5. Intellectual Property

Your Content

You retain ownership of the prompts you submit and the diagrams you create. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Process your prompts to generate diagrams
  • Store and display your diagrams as part of the Service
  • Use anonymized data to improve our AI models (unless you opt out)

Our Content

The Service, including all software, design, text, graphics, and other content (excluding user-generated content), is owned by CloudA.ai and protected by copyright, trademark, and other intellectual property laws.

AI-Generated Diagrams

Diagrams generated by our AI are provided to you under a license that allows you to use, modify, and distribute them for commercial and non-commercial purposes. However, you cannot claim exclusive ownership of AI-generated content in its original form.

6. Pricing and Payment

Credits System

Our Service uses a credit-based pricing model:

  • Credits are consumed when you generate diagrams with AI
  • Pricing and credit costs are subject to change with notice
  • Unused credits may expire according to our pricing terms
  • Refunds are handled on a case-by-case basis

Billing

By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for all charges, including applicable taxes.

7. Usage Limits and Fair Use

To ensure service quality for all users, we may impose usage limits including:

  • Rate limits on API requests and diagram generation
  • Storage limits for saved diagrams
  • Restrictions on automated or bulk usage

We reserve the right to suspend or terminate accounts that abuse the Service or violate fair use principles.

8. Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI Limitations

We do not warrant that:

  • AI-generated diagrams will be accurate, complete, or error-free
  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, or secure
  • Any errors will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUDA.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless CloudA.ai and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content and prompts submitted to the Service

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

11. Export Compliance

You agree to comply with all applicable export and import control laws and regulations in your use of the Service and any exported diagrams or content.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to the Service

We reserve the right to modify or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
